There are also insurance company adjusters who have been telling policyholders that Public Insurance Adjusters are not certified by FEMA to settle flood damage claims.  This may be an attempt to dissuade policyholders from obtaining legal representation or in some cases these adjusters are being misinformed by their management.

This is incorrect information as in-house insurance company adjusters, independent insurance adjusters and general adjusters who adjust claims for insurance companies must be trained and then tested by FEMA in order to qualify for flood a adjustment certification.

New York State public adjusters are tested and licensed by the Department of Insurance to adjust property claims which include FEMA claims. FEMA does not avail its certification to Public Adjusters as New York State already certifies them.

What is a Public Adjuster?

Section 2101 Agents, Brokers, & Adjusters Article 21    “Public Adjuster” means any person, firm, association or corporation who, or which, for money, commission or any thing of value, acts or aids in any manner, commission or any other thing of value, acts or aids in any manner on behalf of an insured in negotiating for, or effecting, the settlement of a claim or claims for loss or damage to property of the insured in New York State caused by, or resulting from, any risks as enumerated in Section 1113 of Article 11 of the New York Codes Rules & Regulations, or which, advertises for, or solicits employment as an adjuster of such claims, and shall also include any person who, for money, commission or any other thing of value, solicits, investigates, or adjusts such claims on behalf of any such public adjuster.
